I dont owe a debt. They keep calling looking for someone named Linda Lavacolla. I have told them over and over to NOT call me as I am not linda. Are these people idiots? YES, they are! They keep calling me after I have told them that linda does not live here and that my number is on the do not call list! What is wrong with these people! Do they not understand the English language?? No...maybe they should get a real job and stop harassing vets like myself who work everyday for my money! I have had the same experience. I keep getting recorded messages that ask you to enter numbers on the keypad. I have twice spoken to an actual person and told them that the person they are looking for has never lived at my address and yet these obnoxious idiots still keep on calling.

Hunter Warfield review in Saratoga Springs, New York: Can't even tell us who they are or who they are with.

My husband started out receiving calls from a guy who calls himself "Rick". Yep, just "Rick". He would leave a message each and every time saying the same thing, "Hey, this is Rick, give me a call." Without giving his last name or company info. Really? We seriously thought he had the wrong number. I mean, wouldn't anybody? So we never answered, until he called DAILY. Finally when we found the time to find out who Rick was, apparently he's with some collection agency that cannot reveal it's name to us.(We found out the name when the money came out of our bank) He would not tell us ANYTHING about the company. How do you expect us to pay you when we know NOTHING about you, and you keep calling us with those *** voicemails? For the record, NO, we are not on first name basis here. You should refer to my husband as Mr.(insert last name here) or Petty Officer(Insert last name here), whichever floats your boat. He is way too busy being a part of your freedom while you leave him such ignorant unprofessional messages. Thank you.

Debt collectors can not leave messages like that on your phone...they have what is called a "foti message." If they leave a message, it has to be done in that format.

Oh, and harassment is actually defined by the consumer...your husband. So if he feels like being called on a daily basis is harassment, then it is. Check out your state laws as well, some are much stricter then the FDCPA.

Also, the collector can not misrepresent himself. He can not give your husband the impression that he is say from the IRS or your bank. I was a collector and was trained to introduce myself by my first name only. If a person asked "who?" then I could say my first name then the company I am with.

Under NO circumstance can a debt collector lie to you. If he tells your husband that they will take him to court, his company better be able to do that. BUT they can not threaten you either: "We will take you to court if you don't pay." They CAN explain the consequences..."if my client chooses to do so, they can move this forward for further measures such as tax offset, wage garnishment..."

I would rather you teach them an expensive lesson. They violated FDCPA by calling you after you told her not to. If you can prove that in a small claims court the miscreant will pay you $1000. You want to make it an expensive lesson engage an attorney that's another $3000+/- they have to pay.

Basically your name might match that of someone they are looking for so they call everyone in the country with those names. They count on you not knowing your rights per federal laws.

That's a violation of FDCPA and your rights and you are due about $1000 from them if you can prove that. Be ready for the next call they will almost always violate and you need to capture the evidence as it could be a $$$ windfall for you. Have ready a recorder, camera, pen & paper. When they call again be calm and record the call, photo your call ID then detail who called, when, what said, everything! That's what judges want to see.

Then tell them verbally to cease and desist calling you per federal law TCPA, etc. If they violate that you are due about $1000 if you prove it.

Consumer attorneys will take a case on a contingency basis especially if you have collected slam dunk evidence. It's an $3k that's dropping on their desk that's covered by the misbehaving collector/defendant. For a Dave Ramsey endorsed attorney go to collectionbully.com (or just search at NACA.org).

That is incorrect, the FDCPA prohibits verbal Cease and Desist. It must be in writing, there are a few states (Ohio for example) that do allow them, but normally they are no good.
